% 31.01.2018 After lengthy arguments, Ms. Geetanjali Mohan, learned counsel appearing on behalf of the appellant seeks leave to withdraw this appeal in view of the circumstance that the amount in question is only in the sum of Rs. 20,659/-, which constituted the quantum of gratuity withheld by the appellant on account of an alleged over-stay in the official accommodation.
Leave granted.
The appeal and the pending applications are dismissed as withdrawn and disposed off accordingly.
However, the amount of Rs. 25,000/-, which was directed to be paid by the appellant to the legal representatives of the respondent workmen, is converted to the litigation expenses in accord with the
principles enunciated in the catena of judicial decisions under the Industrial Disputes Act, 1947.
