The petition has been filed on the pleading that the dispute has been settled with the complainant.

Learned counsel for the complainant impleaded as respondent No.2 disputes any settlement. I have asked learned counsel for the petitioner to show the settlement. The petitioner is present in Court and concedes that there is no written settlement between the parties. 2.

Reliance for the alleged settlement is placed upon receipts collectively annexed as Annexure P-3.

A perusal of the FIR would evince that the cheating is to the tune of Rupees Ten Lakhs.

Since the complainant disputes a settlement the instant petition is

being dismissed. Should the petitioner enter into a complete settlement with the complainant the petitioner would be entitled to file a fresh petition enclosing the settlement, which should be in writing. The complainant should join as a co-petitioner and presence of the complainant ensured in Court.
