Though in yesterday's order, it is recorded that the suit could not be taken up owing to Full Court Reference to bid farewell to Justice Badar Durrez Ahmed but Mr. Bahar U. Barqi, counsel for the plaintiff had mentioned the matter on 28th March, 2017 for adjournment on 29th March, 2017 expressing personal difficulty and he was informed that the suit will be taken up today i.e. 30th March, 2017 and to which he had agreed. 3.

It appears that in view of the observations contained in the order dated 15th March, 2017, the plaintiff does not want to pursue the suit, though is not willing to withdraw the same as advised by its counsel Mr. Barqi and as recorded in the order dated 20th March, 2017. 4.

Dismissed in default.
