% 23.02.2018 By this petition, the petitioner seeks bail in case FIR No. 65/2017 under Section 420/467/468/471/120(B) IPC registered at PS Bhajanpura on the complaint of one Girish Chander.

In the complaint Girish Chander alleged that the petitioner received a sum of ₹8,50,000/- on account of sale of a plot but now neither the money is being returned nor he has been handed over the possession of the plot. According to the complainant, the property was purchased from Gauri Shankar only on the assurance of property dealer i.e. Sudheer Chauhan and a total amount of ₹8,50,000/- was taken on 14th December, 2015 in lieu of GPA Notary executed in the name of Girish Chand. On 17th December, 2015 the complainant went to take possession of the property when he was told that the property is non-existent and the plot that was shown to him was U29/1, Shiv Vihar Delhi and the owner was found to be one Kishan Pal Singh. It is the case of the prosecution that despite agreeing to return the total sum of ₹8,50,000/- the petitioner till date has not returned the amount. The petitioner is in custody in the above noted FIR since 29th April, 2017. The charge sheet has since been filed. The trial is likely to take time. Considering that the petitioner has been in custody for the last 10 months this court deems it fit to grant bail to the petitioner in the above-noted FIR subject to the petitioner furnishing a personal bond in the sum of ₹25,000/- with one surety bond of the like amount subject to the satisfaction of the learned Trial Court. The petitioner will not leave the country without the prior permission of the Court concerned and in case of change of his residential address the same will be intimated to the Court concerned by way of an affidavit.

Petition is disposed of. Order dasti.
