% 19.12.2017 CRL. M.A. Nos. 21011/2017 & 21012/2017 Allowed, subject to all just exceptions.

Applications stand disposed off.

W.P.(CRL) 3552/2017 This petition seeks quashing of FIR No. 422/2017 dated 21.11.2017 under sections 454/380 IPC registered at Police Station Palam Village, New Delhi on a complaint by respondent no. 2, Ms. Deepika Devendra Trivedi daughter of Mr. Tuljashankar Trivedi. The lis between the parties has since been amicably settled. According to the Settlement Deed dated 16.12.2017, the complainant has to receive an amount of Rs. 3,20,000/-, of which Rs. 40,000/- remains to be paid which has been paid to her in Court through her counsel. The parties are present in the Court and have been identified by the Investigating Officer as well as by their counsel. The parties undertake to

abide by the terms of the aforesaid Settlement Deed. Their undertakings are accepted.

Since the complainant does not wish to pursue the complaint and has compromised the matter with the petitioners, the substratum of the FIR is largely eroded. Keeping the FIR alive would serve no purpose and any proceeding emanating therefrom would be an exercise in futility. In view of the above, FIR No. 422/2017 dated 21.11.2017 under sections 454/380 IPC registered at Police Station Palam Village, New Delhi and all proceedings emanating therefrom are hereby quashed. The petition is disposed off in the above terms. NAJMI WAZIRI, J DECEMBER 19, 2017 RW
