versus GOVT. OF NCT OF DELHI AND ORS.

..... Respondents Through:

Mr Gautam Narayan, ASC with Ms Shivani Vij, Advocate for GNCTD.

Mr Santosh Kumar Tripathi, Standing Counsel with Mr Shashank Tiwari and Ms Sukriti, Advocates for R-2.

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 14.12.2018 1.

The petitioner has filed the present petition, inter alia, praying that directions be issued to respondents to take immediate and necessary steps in respect of construction of bus shelters (BQS) on the route from KapasheraGurugram to Dhaula Kuan and on the route from Dhaula Kuan to Gurugram-Kapashera.

2.

The petitioner, essentially, aggrieved by the removal of BQS, near the area Village Rangpuri, New Delhi on the said routes. The petitioner made several representations, however, it is the petitioner's claim that the same has not be considered.

3.

The learned counsel appearing for the respondents submits that BQS at the location can be made only with the concurrence of National Highway

Authority of India (NHAI), which is not the party to the present petition. 4.

Plainly, it is not apposite for this Court to determine the location where BQS should be constructed. It is open for the petitioner to make an appropriate representation to NHAI and / or the concerned authorities. The respondents on their own part would also consider the petitioner's representation and take an informed decision. 5.

The petition is disposed of with the aforesaid observations. VIBHU BAKHRU, J DECEMBER 14, 2018 RK
