At the outset, Mr Sanjay Jain, learned ASG appearing for the respondents states that the attachment order under Section 5(1) has already been passed in respect of the amounts maintained by the petitioner in his bank accounts. In this view, the petitioner would have his remedies against the said order as available under the provisions of Prevention of Money Laundering Act, 2002 (PMLA).

Mr Jain further states that there is no objection if the directions stated in paragraph 6 of the order dated 22.12.2017 - which are to the effect that the petitioner would maintain the balance as available in the bank accounts as on 22.12.2017 and would be free to operate the bank accounts for any sums deposited thereafter - is continued subject to any further orders that
may be passed by the competent authority. It is so directed. 3.
The question whether orders freezing bank accounts, which can neither orders are Sections 5 nor under 17 of the PMLA is left open to considered in an appropriate case.
