W.P.(CRL) 2/2018 This petition has been filed seeking quashing of FIR No.639/2014 registered under Sections 419/420/468/471/120B/34 of the IPC at police station Harsh Vihar. The complainant is Suresh Ram Gupta. This Court has been informed that the parties have entered into a settlement and the earnest money which had been paid by the complainant to the petitioner has since been returned back.
The complainant is present in Court. He is duly represented by his counsel. He endorses this settlement. The complainant has received a total sum of Rs.3,65,000/- which is the full and final settlement entered into between the parties before the Delhi Mediation Centre, Karkardooma Courts, Delhi. The settlement agreement dated 17.10.2017 executed before the Delhi Mediation Centre, Karkardooma Courts, Delhi is a part of the record. Petitioner is accordingly seeking quashing of the FIR.
In the interest of justice and noting the inter se settlement arrived at between the parties which has been endorsed by the complainant, this Court is of the view that no fruitful purpose would be served in continuing these proceedings any further; it would be a wastage of the precious time of the Court as the end result would be a result in futility. Accordingly, FIR No.639/2014 registered under Sections 419/420/468/471/120B/34 of the IPC at police station Harsh Vihar and all proceedings emanating therefrom stand quashed. Petition disposed of.
