IN THE HIGH COURT OF DELHI AT NEW DELHI
+ CRL.M.C. 5412/2017 VIRENDER KUMAR & ORS ..... Petitioners Through Mr. Dinesh Sah, Adv versus THE STATE GOVT OF NCT OF DELHI & ORS ..... Respondents Through Dr. M P Singh, APP for State SI Mukesh Kumar, PS Bindapur Respondent nos.2 to 5 in person
CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 27.08.2018 It is submitted that petitioners and respondent nos. 2 to 5 have settled their disputes in terms of Memorandum of Understanding dated 25th February, 2014, therefore, FIR No.439/2013 under sections 420/467/471/448/120-B IPC registered at police station Bindapur may be quashed.
Respondent nos.2 to 5 are present in Court and have been identified by SI Mukesh Kumar of police station Bindapur. They submit that they have settled the matter with petitioners of their own free will and without any undue force, pressure or coercion and in view of the settlement, each of them have received compensation of `15,000/- from the petitioners. They further submit that they have no objection in case the aforesaid FIR and consequent proceedings emanating therefrom, are quashed.
Keeping in mind the settlement arrived at between the petitioners and respondent nos. 2 to 5 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, FIR No.439/2013 under sections 420/468/471/448 IPC registered at police station Bindapur and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Dasti. A.K. PATHAK, J AUGUST 27, 2018 sm
