Learned APP accepts notice for respondent no. 1.
Respondent no.2 Ms. Nashim is present in Court along with her counsel and accepts notice. She has been identified by SI Avdesh of police station Vijay Vihar.
Learned APP submits that relatives of petitioner, namely, Mr. Shamshuddinal, Mr. Hafizan, Ms. Warisa, Mr. Vakil, Ms. Sitara, Ms. Munni, Mr. Sakeel and Mr. Fahim are also accused but have not been impleaded. On the oral prayer made by the learned counsel for petitioner, these persons are impleaded as respondent nos. 3 to 10. Amended memo of
parties be filed during the course of the day. Respondent no.2 submits that she has settled the matter with the petitioner of her own free will and without any undue force, pressure or coercion. Respondent no. 2 further submits that she has received the entire settled amount and she has no objection in case the FIR no.1404/2014 under Sections 498-A/406/34 IPC registered at Police Station Vijay Vihar and consequent proceedings emanating therefrom are quashed against the petitioner and his relatives, that is, respondent nos. 3 to 10. Keeping in mind the settlement arrived at between the petitioner and respondent no.2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and consequent proceedings emanating therefrom are quashed against the petitioner and respondent nos. 3 to 10. Petition is disposed of in the above terms.
