The instant appeal has been filed for reduction of the award dated 01.10.2018 passed by the learned MACT, awarding a compensation of Rs.49,37,000/- along with interest @ 9 % p.a. from the date of filing of claim petition.

On appeal, the insurance company deposited 50% amount as per the award along with interest as the appellant has been held liable to pay only 50% of the amount in terms of the award. 3.

We find that the Bajaj Alliance General Insurance Company Ltd. and Oriental General Insurance Co. Ltd. being the insurers of the offending vehicles were directed to deposit the awarded amount in the ratio of 50:50 before the concerned Tribunal with SBI, Rohini Branch. Learned counsel for the appellant submits that the appellant is liable only to pay its share of 50% of the compensation awarded by the Tribunal as the liability and accordingly, deposited the complete amount with interest before the Registrar General of this Court. 5.

It is submitted by the learned counsel for the appellant that the said deposited amount has already been released to the beneficiaries of the award in terms of the order dated 22.08.2019. 6.

Learned counsel for the R-1 to 4 have submitted that the said amount has already been released and has stated that they have not file an appeal for enhancement of the award and further submitted that they shall not be filing any appeal for enhancement and the settlement arrived in the instant appeal is a full and final settlement between the parties. It is made clear that respective rights of the parties stands protected. 7.

The statutory amount with interest, if any, be refunded to the appellant.

In terms of the aforesaid, the present appeal along with pending application(s) stand disposed of.
