No one appeared on the last date of hearing i.e. 13th September, 2018. 3.

Learned counsel for the defendant submits that he sent the copy of this order to the plaintiff's counsel on 17th September, 2018. Learned counsel further submits that he intimated the plaintiff's counsel on his mobile on 17th September, 2018 and also sent a Text message on 18th September, 2018. Copy of the Text message is handed over and taken on record.

This Court is of the view that the plaintiff is not interested to pursue this suit and is therefore, not appearing despite being specifically intimated about the today's date of hearing.

The suit is dismissed in default.
