Learned counsel for the petitioner states that she may be permitted to withdraw the present petition, while reserving the right of the petitioner to directly approach the respondents with a request to relax his medical criteria for considering him for promotion to the rank of Second in Commandant and Commandant in the BSF from the date his juniors were promoted to the said post.

If the said representation is made by the petitioner, the same shall be considered and decided by the respondents by passing a speaking order within eight weeks therefrom, under written intimation to him. If the grievance of the petitioner still survives, he shall be entitled to seek legal recourse.
