% 30.08.2016 Since the Appellate Tribunal, MCD (ATMCD) has stayed the demolition of property bearing no.72, Chirag Delhi, Village New Delhi on an appeal being filed by the occupier of the said property, the present contempt petition is disposed of with liberty to the petitioner to file an impleadment application before the ATMCD. The petitioner is also given liberty to file fresh proceedings in accordance with law after the ATMCD disposes of the appeal filed by the owner/occupier of the property in question. This Court clarifies that it has not expressed any opinion on the merits of the controversy. The rights and contentions of all the parties are left open.
