% 23.05.2018 This petition under Section 11 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as the 'Act') has been filed by the petitioner seeking appointment of an Arbitrator for adjudicating the disputes that have arisen between the parties in relation to the Agreement dated 31.08.2013 for Construction of Ramp and Adjoining Corridor Near Neurology Block at IHBAS.
During the course of arguments, the counsel for the respondent has handed over a list of three proposed Arbitrators to the counsel for the petitioner. The counsel for the petitioner submits that the petitioner has no objection to the appointment of Mr.O.P. Gaddhyan, Former ADG, CPWD as a Sole Arbitrator.
Accordingly, Mr.O.P. Gaddhyan, Former ADG, CPWD (R/o Flat No.-001, Tower No. A-1 (East), The World SPA (East) Near-Jalvayuvihar, Sec-30&41, Gurugram (Harayana), Mobile:9910952001) is appointed as a
Sole Arbitrator for adjudicating the disputes that have arisen between the parties in relation to the above mentioned Agreement. The Arbitrator shall give to the parties his disclosure in terms of Section 12 of the Act before proceedings with the reference. The Arbitrator shall be entitled to fee as prescribed in the Fourth Schedule to the Act. The respondent shall be entitled to raise all claims and submissions before the Arbitrator. The petition is allowed in the above terms and with no order as to cost.
