This is a petition under Section 482 Cr.P.C. for quashing of FIR No.532/2017 U/S 279/337 IPC registered at Police Station KN Katju Marg and the consequent proceedings emanating therefrom. 2.
It is contended that because a road accident, injury was sustained by the minor child of respondent Nos.2 and 3, who suffered a fracture. Learned counsel for the petitioner submits that the minor child has been treated and has since recovered and an amicable settlement has been arrived at between the petitioner and the respondent Nos.2 and 3, whereby, the petitioner has agreed to pay a sum of Rs.1,10,000/- to the respondent Nos.2 and 3 as compensation.

The respondent Nos.2 and 3 are present in Court and are identified by their counsel as well as the Investigating Officer. They contend that their child has since been treated in the hospital and has recovered. They CRL.M.C. 30/2018
submit that they have settled with the petitioner and do not wish to press the present petition.

The petitioner has handed over a sum of Rs.1,00,000/- by way of a Demand Draft bearing No.116039 drawn on Bank of Maharashtra in favour of the minor child Nand Lal and a sum of Rs.10,000/- by way of a Demand Draft bearing No.116038 drawn on Bank of Maharashtra in favour of Smt. Rekha.
Mr. Satish, father of the minor child submits that out of Rs.1,00,000/-, he shall be making a fixed deposit of Rs.50,000/- in the name of the minor child to be utilized by him on attaining majority and Rs.50,000/- would be appropriated towards the expenses incurred by him. 5.
In view of the fact that the parties have settled their disputes and also the fact that the minor child has since been treated and has recovered and the fact that the respondent Nos.2 and 3 do not wish to press the complaint any further, it would be expedient and, in the interest of justice, not to continue with the proceedings any further.

Accordingly, FIR No.532/2017 U/S 279/337 IPC; Police Station KN Katju Marg and the consequent proceedings arising therefrom are quashed. 7.
