% 01.02.2018 After some arguments, Mr. Sanjay Poddar, the learned Senior Advocate for the appellant states upon instructions that, he would not press the present appeal should the Trial Court be directed to dispose off the suit within a fixed time.

The learned counsel for the parties submit that recording of evidence has already commenced before the Trial Court and is expected to be completed by the end of March, 2018. In the circumstances, the Trial Court is requested to expedite the hearing of the case and dispose it off in six months, following completion of recording of the evidence.

The learned counsel for the parties submit that they would not

seek any adjournment in the matter and shall assist the Trial Court on every date so fixed for expeditious disposal of the suit. The appeal is disposed-off in the above terms. NAJMI WAZIRI, J FEBRUARY 01, 2018/acm
