% 22.12.2017 1.
The petitioner has filed the present petition, inasmuch as the petitioner is aggrieved by the list of disqualified directors published by the respondents to the extent it includes the name of the petitioner. 2.
The learned counsel for the petitioner contends that the petitioner has been shown as a disqualified director on account of non-filing of returns in relation to Alchemist Township India Limited (hereafter 'the Company'). He states that the Company's Master Data, as downloaded from the website of the respondents indicates that the balance sheet of the company as on 31.03.2014 had been filed and, therefore, the default in filing the final accounts/returns does not extend to three consecutive years; yet the petitioner has been disqualified with effect from 01.11.2016 to 31.10.2021.
3.
The learned counsel for the petitioner states that the petitioner seeks to withdraw the present petition, without prejudice to the petitioner's rights and contentions, to avail of the Condonation of Delay scheme -2018. 5.
The petition alongwith the application is dismissed as withdrawn with the aforesaid liberty.
6.
It is clarified that all contentions of the petitioner are left open. VIBHU BAKHRU, J DECEMBER 22, 2017 pkv
