% 01.03.2018 In spite of service of notice, none appears for the respondents. Learned counsel for the petitioner informs that the Arbitral Tribunal has already been constituted and the Arbitrator has issued notices to the parties for their appearance.
In view of the above, interim order dated 09.01.2018 is hereby confirmed. It would, however, be open to the respondents to approach the Arbitral Tribunal for its modification/vacation by moving an appropriate application.
I may only clarify that this Court has not made any observation on merit of the claim of either party and the same are kept open before the Arbitral Tribunal.
The petition is allowed in the above terms with no order as to cost. Dasti.
