O R D E R

The petitioner seeks quashing of FIR No. 792 of 2017 under Sections 394/34 of the IPC Police Station Samaipur Badli, Delhi, on the basis of a settlement.

The allegations in the FIR are that the petitioners had stolen money from the pocket of Sh. Chunni Lal, uncle of respondent no. 2. Mr. Chunni Lal is also present in court and is identified by the IO. He submits that he has also stated before the IO on 08.02.2018 that he has settled with the petitioner.

A sum of Rs. 30,000/- was paid by the petitioners to respondent no. 2 in full and final settlement of all the claims and for settlement of disputes and no issue or dispute between the parties is stated to be CRL.M.C. 5439/2017

remaining.

Respondent no. 2 is present in court in person and is identified by the Investigating Officer. He submits that he has settled the dispute with the petitioners and is agreeable to the settlement and does not wish to press criminal charges against the petitioners any further. Settlement deed dated 01.12.2017 has been executed between the parties.

In view of the fact that the disputes between the petitioners and respondent no. 2 have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating there from.

In view of the above, the petition is allowed. FIR No. 792 of 2017 under Sections 394/34 of the IPC Police Station Samaipur Badli, Delhi and the consequent proceedings there from are, accordingly quashed.
