O.M.P.(MISC.)(COMM.) 2/2018 O.M.P.(MISC.)(COMM.) 3/2018 On 29.11.2010 respondent No.3 entered into license agreement with petitioner for providing Ground Handling Services to the interested airlines at Chennai and Kolkata Airports and to the interested airline at Trivandrum, Calicut, Coimbatore, Mangalore, Trichy Airport(s) located at Southern Region. On 27.11.2015 the

Respondent invoked the arbitration clause under the license agreements. On 11.01.2016 in pursuance of the same the petitioner appointed Hon'ble Mr. Justice S.S Nijjar (Retd.) as a sole Arbitrator. On 01.03.2016 the learned Sole Arbitrator entered into reference. On 22.03.2016 the first hearing before the Ld. Sole Arbitral was held. On 04.05.2016 the respondent filed its claim petition. On 15.06.2016 respondent filed its statement of defense. On 25.08.2016 respondent filed its counter claim. On 01.08.2016 the learned Sole Arbitrator on the basis of the pleadings of the Petitioner and Respondent and submissions of the documents of both the parties framed the issues. The parties had mutually agreed to extend this time limit for a further period of six months i.e. till 11.07.

2017 in view of Section 29A(3), Arbitration and Conciliation Act, 1996. On 24.03.2017 the parties mutually agreed to file the application under section 29A(4) for extension of arbitration proceedings for a further period of six months i.e. till 11.01.2018 in the above captioned matter. On 24.04.2017 order was passed by the High Court of Delhi in O.M.P.(MISC.)(COMM.) 2/2017 dated 24.04.2017 extending the period of arbitration proceeding till 31.01.2018. On 26.10.2017 the final arguments in the matter has begin, however, the same have remained inconclusive. On 08.12.2017 the parties again mutually agreed to file the present application under section 29A(4) for extension of arbitration proceedings for a further period i.e. till 31.07.2018.

Counsels for both the parties since request for extension of time for arbitration proceedings, hence the time for conducting arbitration

proceedings stand extended till 31st July, 2018. The petitions are disposed of.
