% 21.12.2017 Present FIR No. 23/2016 under Sections 354/323 IPC was registered against the petitioner at police station Shahdara on the complaint of respondent no.2.

After the investigation, charge-sheet was filed under Sections 323/354/506/509 IPC.

Respondent no.2-Savita Sharma is present in Court along with her counsel and has been identified by SI Suresh Chand of police station Shahdara.

She submits that she has settled the matter with the petitioner vide Memorandum of Understanding (MOU) dated 1st December, 2017 of her own free will and without any undue force, pressure or coercion. She has identified her signatures on the MOU. Affidavit of respondent no.2 is

also on record wherein she has stated that she does not wish to pursue the proceedings arising out of the aforesaid FIR and the same may be quashed in view of the settlement.

Keeping in mind that a settlement has been arrived at between the petitioner and respondent no.2 voluntarily, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
