% 16.03.2018 Notice. Learned APP accepts notice. Respondent no.2 is present in Court along with her counsel, who accepts notice. She has been identified by W/Insp. Rajni Chopra of police station Khyala. Respondent no.2 submits that she has settled the matter with the petitioner of her own free will and without any undue force, pressure or coercion before the Counselling Cell, Family Court, Tis Hazari Court, Delhi on 21st December, 2016.

She further submits that her marriage with petitioner has already been dissolved by a decree of divorce by mutual consent on 8th September, 2017 passed by the Family Court, West District, Tis Hazari Court, Delhi. Petitioner has paid `5 lacs to the respondent no.2

today in Court vide a demand draft, photocopy whereof has been placed on record. Respondent no.2 submits that with this payment entire settled amount, that is, `30 lacs stands paid and she has no objection in case FIR No.140/2009 under Sections 498A/406/34 IPC registered at police station are quashed. Respondent no.2 has also handed over key of house no. E-27, First Floor with roof, Sham Nagar,Tilak Nagar, New Delhi - 110018 to the petitioner in Court today, which has been duly accepted by the petitioner. She submits that the said house is vacant and possession is being handed over to the petitioner.

Keeping in mind the settlement arrived at between the petitioner and respondent no.2 voluntarily, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms.
