The petitioner seeks quashing of FIR No. 959/2016 under Sections 379/356/411/34 of the IPC Police Station Vasant Vihar (Old), New Delhi.

The allegations in the FIR are that the complainant was going on his motorcycle and the petitioners who were driving Santro Car came in front of motorcycle on account of which a minor altercation took place between the petitioners and respondent no. 2. When respondent no. 2 wanted to call police, petitioners snatched his mobile phone.

The petitioners and respondent no. 2 with the intervention of elders have settled their disputes.

Respondent no. 2 is present in court in person, represented by his counsel and is identified by the Investigating Officer. He submits that he has settled the dispute with the petitioners and is agreeable to the settlement and does not wish to press the criminal charges against the petitioners any further.

In view of the fact that the dispute between the petitioners and respondent no.
has been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.

In view of the above, the petition is allowed. FIR No. 959/2016 under Sections 379/356/411/34 of the IPC Police Station Vasant Vihar (Old), New Delhi and the consequent proceedings emanating therefrom are, accordingly quashed.
