Learned APP accepts notice for respondent no. 1.
Respondent no.2 Mr. Athar Khan is present in Court and accepts notice. He has been identified by SI Jitender Kumar of police station Welcome. It is submitted that petitioners and respondent no. 2 were known to each other. Respondent no. 2 was landlord of petitioner no. 2 at the relevant time. Disputes arose between them, which led to registration of FIR No. 798/2006 under Sections 420/468/471/411/380/506/120-B/34 IPC at police station Welcome. Respondent no.2 submits that he has settled the matter with petitioners of his own free will and without any undue force, pressure
or coercion, vide a Compromise Deed dated 3rd August, 2018. Respondent no. 2 says that he has no objection in case aforesaid FIR and consequent proceedings emanating therefrom are quashed.
Keeping in mind the settlement arrived at between the petitioners and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
