% 27.02.2018 The appellant's grievance is that the respondents' writ petition questioning the order of the Financial Commissioner made on 09.05.2017 was set aside without notice to him.
The Court has heard learned counsel for the respondents. It appears that the learned Single Judge proceeded to allow the writ petition without issuing notice to the appellant who was arrayed as Respondent No.2 in the writ petition. In the circumstances, the impugned order is set aside and remitted to the learned Single Judge who shall proceed to hear the second respondent, in addition to other respondents and pass appropriate orders. The parties are directed to be present before the learned Single Judge on 10.04.2018. The appeal is allowed in terms of the above directions. S. RAVINDRA BHAT, J A. K. CHAWLA, J FEBRUARY 27, 2018/ajk
