% 22.02.2018 The petitioner has not impleaded the concerned Railways as a party to the present writ petition. East Central Railways is a necessary and proper party. We also doubt whether this Court should entertain the present writ petition, as the petitioner is a resident of Chhattisgarh and the incident had occurred in the State of Bihar. At this stage, learned counsel for the petitioner seeks permission to withdraw the present writ petition and file a fresh writ petition before the concerned High Court having territorial jurisdiction. The writ petition is dismissed as withdrawn, with liberty as prayed for.
