% 03.01.2018 The present FIR i.e. FIR No.289/2017 has been registered under Sections 420/468/471/120B of the IPC at police station K.M.Pur on the complaint of Savitri Devi.
This Court notes that the complainant is the sister of the petitioner. The dispute was inter se brother and sister qua an alternative plot allotted to the petitioner pursuant to the acquisition of their land. The petitioner represented himself to be the sole legal heir of late Ram Swaroop (father of the parties); the name of his sister was not disclosed by him. Parties have now arrived at a settlement. A memorandum of understanding has been entered into between the parties on 18.12.2017 wherein the petitioner has paid a sum of Rs.21,00,000/- in full and final settlement of the claim of his sister.
Parties having arrived at a settlement, the petitioner prays that the present FIR proceedings be quashed. In the interest of justice and noting the inter se arrangement arrived at between the parties as also the relationship between the parties, this is a fit case where the FIR should be quashed. Accordingly, FIR No.289/2017 registered under Sections 420/468/471/120B of the IPC at Police Station K.M.Pur and all proceedings emanating therefrom stand quashed. Petition disposed of.
