% 21.12.2017 Crl.M.A. 21305/2017 Exemption allowed subject to just exceptions. W.P.(CRL) 3596/2017 Notice. Learned Standing Counsel for the State accepts notice. By this petition the petitioner seeks parole on the ground that his mother-in-law has passed away. The wife of the petitioner is present in Court. She states that besides her mother having passed away since the condition of the mother of the petitioner is precarious, she cannot even leave Delhi to attend the last rites of her mother. Learned Standing Counsel for the State on instructions submit that the petitioner was earlier granted parole on 16th May, 2017 and he surrendered on 17th July, 2017. The petitioner was further granted parole to perform the W.P.(CRL) 3596/2017

last rites of his father on 18th July, 2017 when he surrendered on 7th August, 2017.

Considering that there is no allegation of misuse against the petitioner at the time when he was earlier granted parole, this Court deems it fit to grant parole to the petitioner for a period of 10 days. It is therefore directed that the petitioner be released on parole on his furnishing a personal bond in the sum of ₹10,000/- with one surety bond of the like amount to the satisfaction of the Superintendent Tihar Jail. Petition is disposed of.
