O.M.P.(I) (COMM.) 554/2017 It is submitted by learned counsel for the respondent that till date they have not issued any notice of termination though certainly are contemplating the said action. Per clause 8.2(a)(ii), in case NDMC decide to terminate the contract a preliminary notice need to be issued to the concessionaire. Said notice has not been issued as yet and hence the petition is premature and is accordingly dismissed with liberty to the petitioner to seek remedies as per law only after such notice is issued.
