% 09.02.2018 Respondent no. 2 is present in Court and has been identified by SI Karamvir of police station Rajouri Garden. She submits that she has settled the matter with the petitioner of her own free will and without any undue force, pressure or coercion. She has no objection in case the present FIR is quashed.
During the course of hearing, it has been pointed out that a cross FIR No. 1594/2015 under Sections 323/341/509/34 IPC was also registered against the respondent no.2 at police station Rajouri Garden on the complain of wife of the petitioner. It is further pointed out that offences involved in the said FIR have already been compounded and respondent no.2 has been acquitted, in view of the compromise arrived at between the petitioner and
respondent no.2.
In the facts and the circumstances of this case as detailed above, I am of the view that no fruitful purpose would be served in keeping the present FIR No.1593/2015 under Sections 323/341/354/427/34 IPC registered at police station Rajouri Garden pending.
Accordingly, in the interest of justice, present FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms.
