The petitioner seeks anticipatory bail in case FIR No. 322/2017, under Sections 308/452/336/427/506/147/148/149/34 IPC and Section 27 Arms Act, registered at P.S. Nangloi.

Issue notice. Notice is accepted by learned APP for the State. 3.
Status report perused.

The subject FIR contends that one Akshay Lakra, Ankit and the petitioner accomplices assaulted the complainant with rods and sticks and threatened to kill the complainant. The subject FIR does not state that the petitioner was carrying any arm or ammunition at the time of incident and is alleged to be carrying a stick.

It is contended that the co-accused have already been enlarged on Bail Appln. 2662/2017
regular bail. It is also contended that the petitioner is a B.A. first year student and has clean antecedents.

The only contention raised in the status report is that the custodial interrogation of the petitioner is required to identify the other co-accused persons and that the petitioner may threaten the complainant. 7.
As noticed above, the other co-accused have already been enlarged on regular bail and the role ascribed to the petitioner is the same as that of the other co-accused who have already been enlarged on regular bail. 8.
Keeping in view the facts and circumstances of the present case, I am of the view that subject to the petitioner cooperating with the investigation, no coercive action shall be taken against the petitioner. 9.
The petitioner shall join the investigation as and when directed by the Investigating Officer and in the event of his arrest, the petitioner shall be released on anticipatory bail on his furnishing bail bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the Investigating Officer/SHO concerned, with the condition that the petitioner shall not contact the complainant or any of the prosecution witnesses and shall also not leave the country without the prior permission of the Court below.

The petition is accordingly disposed of.
