% 11.01.2018 It is submitted that petitioner and respondent no. 2 were known to each other.

When the incident took place, they were living in the same locality. Petitioner and respondent no. 2 have settled their disputes amicably, vide a Compromise Deed dated 18th December, 2018; therefore, FIR No.435/2016 under Sections 394/34 IPC registered at Police Station Vivek Vihar, on the complaint of respondent no. 2, may be quashed. Respondent no. 2 is present in Court and has been identified by ASI Diwan Singh of police station Vivek Vihar. Respondent no. 2 submits that he has settled the matter with petitioner of his own free will, voluntarily and without any undue force, pressure or coercion and he has no objection in case FIR is quashed against the petitioner.

Affidavit of respondent no. 2 is also on record at pages 14 and 15. Keeping in view the settlement arrived at between the petitioner and respondent no. 2 voluntarily, in the interest of justice, FIR No.435/2016 under Sections 394/34 IPC registered at Police Station Vivek Vihar, which is at the investigation stage, is quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
