% 22.12.2017 The petitioner is aggrieved by the fact that although he has filed an appeal against the order of the Revenue Assistant (dated 15.12.2017), there is no person sitting in the office of the Financial Commissioner who can hear his appeal. Submission is that his revision would be infructuous as the impugned order had directed that the possession of the land should be taken forthwith i.e. within a period of one week.
The matter had been passed-over. Learned counsel for the respondents has sought instructions to inform this Court as to whether the Financial Commissioner would be in a position to hear the appeal or not as the vehement submission of the learned counsel for the petitioner is that the Financial Commissioner is not sitting in the office. Learned counsel for the respondents under instructions
submits that the Financial Commissioner is on leave up to 02.01.2018. The Financial Commissioner is directed to hear the revision petition of the petitioner expeditiously and preferably on or before 12.01.2018 (date already fixed before the learned Financial Commissioner). Till that date, no coercive steps be taken. Petition disposed of in the above terms.
