% 09.01.2018 CRL.M.A.450/2018 (Impleadment) 1.

Applicants Amit Gupta and Mukesh Kumar seek impleadment as petitioner, being similarly situated to petitioners 1 and 2. Learned APP and learned counsel appearing for petitioners have no objection. 2.

Accordingly, the application is allowed. Applicants are impleaded as co-petitioners. Amended Memo is taken on record. CRL.M.C. 5539/2017 1.

Petitioners seek quashing of FIR No. 934/2017 under Section 323/341/354/506/509/34 IPC Police Station Narela. The subject FIR has been registered because of an altercation, which is alleged to have taken place outside the factory of the respondent No.2's husband. 2.

Learned counsel for the petitioner submits that the parties with the CRL.M.C. 5539/2017

intervention of respectable and elders of the locality have settled their disputes and have resolved to sought out the differences and have entered into a Deed of Memorandum of Undertaking dated 13/12/2017. 3.

Respondent No.2, who is present in Court in person and has been identified by her counsel as well as the Investigating Officer, submits that she has settled her disputes with the petitioners and does not wish to press any charges against the petitioners.

In view of the fact that parties have settled their disputes and respondent No.2 does not wish to press any charges against the petitioner no fruitful purpose would be served in continuing with the criminal prosecution as there is slim chance of a conviction. Further, in my view, it would be expedient and in the interest of Justice to quash the subject FIR No. 934/2017 under Section 323/341/354/506/509/34 IPC; Police Station Narela and the consequent proceedings arising there from. 5.

Accordingly, the subject FIR No. 934/2017 under Section 323/341/354/506/509/34 IPC and the consequent proceedings arising there from are quashed.
