O R D E R

% 12.02.2018 Petitioner and respondent no.2 are husband and wife. FIR No.877/2017 under sections 307/506 IPC was registered at police station New Usmanpur on the complaint of respondent no.2 wherein she has alleged that petitioner used to beat her up under the influence of liquor. On 19th August, 2017 petitioner picked up a quarrel with her on the pretext that food cooked by her was not good. Thereafter, petitioner picked up a kitchen knife and gave a blow on her neck resulting injury to her.

Respondent no.2 is present in the court and has been identified by SI Prashant of police station New Usman Pur. She submits that she has settled all the disputes with her husband (petitioner) of her own free will and without any undue force, pressure or coercion and

is living with him.

She further submits that she has no complaint against the petitioner and has no objection in case the aforesaid FIR is quashed.

Keeping in view the fact that petitioner and respondent no.2 are living together and respondent no.2 has no grievance against the petitioner, I am of the view that no fruitful purpose would be served to keep the criminal proceedings pending. In the interest of justice, FIR No.877/2017 under sections 307/506 IPC was registered at police station New Usmanpur and the consequent proceedings emanating therefrom are quashed.

Petitions is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti. A.K. PATHAK, J FEBRUARY 12, 2018 sm
