No. 2270/2017 (interim bail) Learned counsel for the petitioner seeks leave to withdraw the application for the reason that the learned Trial Court fell in error noting that it was deciding an anticipatory bail application though the petition before the learned Additional Sessions Judge was for grant of regular bail. He further states that after the passing of the order dated 18th December, 2017 charge sheet has since been filed.

Learned APP for the State countering the argument of learned Senior Counsel for the petitioner states that in the order the Additional Sessions Judge clearly noted that he was considering the case for grant of regular bail. Bail application and application for interim bail are dismissed as withdrawn with liberty to the petitioner to file fresh application before the learned Trial Court.
