Petitioner seeks modification of order dated 30.01.2018 whereby this Court had quashed FIR No.502/2017 under Sections 354/354-D/506/509 IPC, Police Station K.N.Katju Marg, Delhi based on a settlement agreement dated 16.11.2017.

Learned counsel for the petitioner submits that at the time of filing of the petition, he was not aware that Section 12 of POCSO Act has been added pending investigation and as such Section 12 of POCSO Act was not mentioned in the petition.

He prays that the FIR No.502/2017 also under Section 12 of POCSO Act, P.S.K.N.Katju Marg be quashed.

Notice was issued to the respondent No.2. Respondent No.2 is present in Court in person accompanied by her mother. She submits that she has settled with the petitioner and does not wish to press any charges against the petitioner and has no objection to the quashing of FIR inter-alia under Section 12 of POCSO Act. 5.

In view of the above, FIR No.502/2017 under Sections 354/354-D/506/509 IPC and under Section 12 of POCSO Act, Police Station K.N. Katju Marg, Delhi and the consequent proceedings mentioned therefrom are quashed.

Application is allowed in the above terms.
