% 19.01.2016 Respondent has been served. None has appeared for him. The petitioner before this Court is the estranged wife of the respondent. She has filed proceedings under Section 13 of the Hindu Marriage Act (hereinafter referred as the „said Act‟) which are stated to be pending before the Court of Principal Family Judge, Karkardooma Courts. This petition had been filed prior in time to the subsequent petition which had been filed by the husband under Section 9 of the said Act bearing Suit No. 608/15 which is stated to be pending before the Principal Family Judge, South District, Saket. Contention is that to avoid conflict of judgments, it would be appropriate if both the petitions are tried by the same Court and it would be appropriate, if the proceedings pending before the Principal Family Judge, South District, Saket be transferred to the Principal Family Judge, Shahdara District, Karkardooma.

Noting the above factual matrix, the prayer made in the petition is allowed and suit No. 608/2015 titled Vaibha Mehta Vs. Chandni pending before the Court of Principal Family Judge, South District, Saket is transferred to the Court of the Principal Family Judge, Shahdara District, Karkardooma. Complete record of this case be transferred to the Court of Principal Family Judge, Shahdara District, Karkardooma. Petition disposed of.
