W.P.(CRL) 2315/2015 The petitioner was released on parole by the competent authority in the month of August for 15 days for attending to his ailing parents, petitioner being the only son.

Later, an application was filed by the petitioner seeking extension of the parole. Before the application could be taken up, the time period of parole expired and the petitioner had to surrender before the jail authorities.

The petitioner was again granted parole for 15 days and he was released pursuant to such order of the competent authority on 29.9.2015. The aforesaid parole was granted taking into account the fact that his father had to undergo CABG Surgery (bypass operation) on 18.6.2014. It is submitted that after the operation, while the father of the petitioner was convalescing in the hospital, the doctors suspected prostate cancer and necessary tests were conducted. It has further been submitted by the petitioner that for getting the tests completed and for making arrangements for the operation of his father, the petitioner made a prayer for extension of the parole before the competent authority on 30.9.2015 but no action has been taken till date. The period of parole expires on 15.10.2015.

Considering the aforesaid submissions of the petitioner, the parole period is extended for a further period of 15 days to be counted from 15.10.2015. In the meantime, the competent authority shall pass necessary orders on the application preferred by the petitioner for extension of parole. The terms and conditions on which the parole was granted, shall subsist with the extended period of parole.

The petition is disposed of.
