Learned counsel for the petitioner states that when the present petition was filed, the inquiry initiated against the petitioner had yet to be concluded but during pendency of the petition, the inquiry has concluded and the disciplinary authority has inflicted the punishment of "stoppage of two increments without cumulative effect" on the petitioner. He states that aggrieved by the said order, the petitioner has filed a statutory appeal before the Appellate Authority, which is pending consideration. 2.

In view of the subsequent events, learned counsel for the petitioner seeks leave to withdraw the present petition, while reserving the right of the petitioner to file a fresh petition in the event his statutory appeal is dismissed.
