% 06.07.2018 After some arguments, in view of the circumstance that the prayer sought for in the present petition cannot be granted in these proceedings, learned counsel appearing on behalf of the petitioner seeks leave to withdraw the petition with liberty to institute appropriate proceedings, in accordance with law.

Leave and liberty granted.

However, in view of the circumstance that the initial cause of action arose in the year 2014, and the petitioner has been diligently prosecuting the present proceedings before this Court, it would be appropriate for this Court to exclude the period taken in the present proceedings, from being reckoned for the purpose of limitation, in the appropriate proceedings to be instituted on behalf of the petitioner.

Directed accordingly.
