Learned counsel for the respondents opposes the present petition on the ground that it is hopelessly barred by delay and latches, inasmuch as the petitioner seeks to assail an order dated 19.09.2011, passed by the Central Administrative Tribunal in O.A. 07/2011, after almost seven years. 2.

Learned counsel for the petitioner states on instructions that recently, the respondents have passed an order dated 20.09.2017, informing the petitioner that it has been decided to treat him as a government employee w.e.f. 23.08.2001. He states that the petitioner is claiming his entitlement for being treated as a government servant w.e.f. 08.10.1997 and not from 23.08.2001.

In view of the above development, learned counsel for the petitioner seeks leave to withdraw the present petition while reserving the right of the petitioner to file a petition before the Tribunal against the order dated 20.09.2017, passed by the respondents.
