% 08.01.2018 Petitioners and respondent no.2 are neighbours. A quarrel appears to had taken place between them on some trivial issue wherein petitioners assaulted the respondent no.2 resulting in simple injuries to him. This incident led to registration of FIR No. 814/2016 under Sections 308/34 IPC against the petitioners at police station Nand Nagri, on the complaint of respondent no.2.
Respondent no.2 is present in Court and has been identified by SI Ombir Singh of police station Nand Nagri. He submits that he has settled the matter with the petitioners of his own free will and without any undue force, pressure or coercion. Statement of respondent no.2, on oath, has been
recorded separately wherein he has reiterated that he has settled the matter with the petitioners voluntarily. He has no objection in case the FIR is quashed.
Keeping in view the facts and circumstances of the case as detailed above, in the interest of justice, aforesaid FIR, which is at the investigation stage, is quashed in view of the settlement.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
