O R D E R

% 10.01.2018 Ms.Acharya, learned senior counsel for the petitioner submits that in the present petition, the petitioner has prayed for a direction to the Respondent to extend the last cut off date of 29.11.2017, to carry out counselling for admission in B.A.M.S. course for the academic session 2017-2018 since the seats could not be filled up by 29.11.2017 on account of elections in the State during the said period. While drawing my attention to the letter dated 19.12.2017 (Annexure P 12), she submits that based on the order of the High Court of Uttarakhand, the Respondent has already extended the time for completing the admission by 15 days.

Ms.Acharya also hands over a copy of the letter dated 18th December, 2017 written by the Secretary, Govt. of U.P., requesting the Respondent to extend the last cut off date for admission to fill up the vacant seats for the undergraduate course for the academic session 2017-18 in Ayurvedic/Greek/Homeopathy Medical Colleges of private sector of U.P., by further fifteen days. The copy of the said letter is taken on record.

Ms.Acharya further submits that at this stage, she is only confining her relief for issuance of a direction to the Respondent to decide the Petitioner's representation dated 04.12.2017 and pass a reasoned and speaking order by taking into consideration the letter dated 18.12.2017 written by Secretary, Government of Uttar Pradesh as also the letter dated 19.12.2017 issued by the Respondent extending the time for making admission to fill up the vacant seats in respect of Smt.Manjira Devi Shikshan & Prashikshan Samiti Uttrakhand.

The petition is accordingly disposed of with a direction to the Respondent to decide the petitioner's representation within one week by passing a reasoned and speaking order and taking into consideration both the letters dated 18.12.2017 & 19.12.2017 referred to hereinabove. Needless to say that if the petitioner is still aggrieved, it will be entitled to seek remedy available in law. Dasti.
