% 14.12.2018 In all these ten petitions, the learned counsel for the petitioner has raised a common grievance viz, the learned Trial Court has fixed the money suits for its consideration after about a month of filing and when on the next date the application under Order XL Rule 1 Civil Procedure Code was argued it was also kept for consideration after about two months and the orders were also not passed. The learned counsel for the petitioner argued the manner of

working of the learned Trial Court is against the decisions given in A.Venkatasubbiah Naidu vs S.Chellappan & Others 2000 7 SCC 695 as well as State Bank of India vs. Trade Aid Paper and Allied Products (India) Pvt Limited & Others AIR 1995 Bom 26. The learned counsel for the petitioner however prays to the extent the petitioner bank shall be satisfied if the pending application(s) under Order XL Rule 1 CPC are taken up by the learned Trial Court and be disposed within a week. In view of above, the application (s) under Order XL CPC be disposed by the learned Trial Court as per law within a week from the date of receipt of copy of this order.

The learned Trial Court in future shall endeavour to deal and decide the matter of pressing financial urgencies as expeditiously as possible.

The petition and pending application(s) stands disposed of. The Registry is directed to send copy of this order to the learned Trial Court for information and compliance. Copy of this order be also given dasti to the petitioner under signature of the Court Master.
