% 30.01.2018 The counsel for the respondent points out that the eviction order has already been passed in the eviction case instituted by the respondents, it being E. No.131/2014.

The counsel for the respondent further submits that the eviction order was challenged before this Court in RC. Rev.488/2017 which was also dismissed vide order dated 30.10.2017.

In that view of the matter, the present petition challenging the order dated 31.08.2015 declining the application for amendment of the application for leave to defend and the application filed therewith have become infructuous and are dismissed accordingly.
