% 17.12.2018 Crl.M.A.49945/2018 (exemption) Exemption is allowed subject to all just exceptions. BAIL APPLN. 2982/2018 1.

Learned counsel for the petitioner submits that earlier directions were issued on 11.01.2018 directing the Trial Court to expedite the recording of the evidence and to conclude the same within six months. Subsequently, on 15.11.2018 once again directions were issued to the Trial Court to conclude the examination of prosecution witnesses within two months.

Learned counsel submits that only one witness which is the Malkhana Incharge needs to be examined and the next date fixed for the same is 28.01.2019.

Learned APP under instructions assures that on the next date, the Malkhana Incharge with the case property shall be present in Court.

In view of the above, learned counsel seeks leave to withdraw the petition. However, directions are issued to the Trial Court to endeavour to conclude the recording of the evidence of the Malkhana Incharge on the next date.

Petition is dismissed as withdrawn, with the aforesaid directions.
