The present is a joint application filed under Order XXIII Rule 3, read with Section 151 of the Code of Civil Procedure, 1908 ("CPC"), on behalf the parties for decreeing the suit in terms of the Settlement Agreement dated th February, 2026 between the parties..

been duly recorded in the Settlement Agreement dated 24th February, 2026. Thus, it is submitted that in the light of the said settlement between the parties, the present joint application has been filed, seeking disposal of the present suit by decreeing it in terms thereof. 3.

This Court notes the submissions made by learned counsels appearing for the parties, who are also present in person before the Court that the Settlement Agreement has been entered into out of their own violation, without any coercion, undue influence and fraud. 4.

The Settlement Agreement dated 24th February, 2026 is on record.

This Court has perused the Settlement Agreement and finds the terms therein to be lawful. This Court is satisfied that the settlement has been arrived at between the parties after following the due procedure, and accordingly, the Settlement Agreement meets the essentials specified in Order XXIII Rule 3 of the CPC.

Accordingly, with the consent of the parties, a consent decree is hereby passed in terms of the Settlement Agreement dated 24th February, 2026 and the parties are held bound by the terms of the Settlement. 6.

In view of the aforesaid, the present suit is decreed in terms of the Settlement Agreement, which shall form part of the decree. 7.

Let decree sheet be prepared by the Registry of this Court, with the Settlement Agreement between the parties forming part of the said decree. 8.

Considering the fact that the parties have entered into a Settlement Agreement through the Delhi High Court Mediation and Conciliation Centre, the Registry is further directed to prepare a Certificate in favour of the plaintiff for refund of the full Court Fees. 9.
