O R D E R

% 20.12.2018 By this petition, the petitioner seeks bail in case FIR No. 854/2018 under Sections 308/325/323/34 IPC registered at PS New Usmanpur. The allegations of the injured victim in the above noted FIR are that the petitioner came on a bike and tried to hit the dog by his bike. When the injured victim, namely, Naman objected to it, petitioner stated that the dog would bite him and uttered abusive word to the victim and got down from the bike and slapped him. Thereafter the friends and relatives of the petitioner, namely, Manoj, Jony @ Farhan and Raju @ Kaushal came along with danda and baseball bat and assaulted Naman and the complainant, who is the father of the injured Naman.

The allegations of beating are against Jony @ Farhan, Raju @ Kaushal and Manoj. The allegations against the petitioner are of exhortation. Considering the fact that the petitioner has been in custody since 27th October, 2018 and two other accused are yet to be arrested, this Court deems it fit to grant bail to the petitioner.

It is, therefore, directed that the petitioner be released on bail on his furnishing a personal bond in the sum of ₹25,000/- with one surety bond of the like amount, subject to the satisfaction of the learned Trial Court, further subject to the condition that in case of change of residential address the same will be intimated to the learned Trial Court by way of an affidavit. Petition is disposed of.
